Welcome to HoneyPunkDesigns.com. [HoneyPunkDesigns(HPD)] Please carefully read the following terms and conditions before using our services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services. We look forward to having you as a consumer! Without your support and imagination/ideas we would not exist.  

1. Acceptance of Terms: By using our website, you acknowledge that you have read, understood, and agree to comply with these Terms. We reserve the right to update, modify, or replace any part of these Terms at our discretion. It is your responsibility to check this page periodically for changes. Your continued use of the Website and Socials (Twitter, Youtube, Instagram, Patreon, Ko-Fi, and ETSY) following the posting of any changes constitutes acceptance of those changes.  

1. User Eligibility: You must be at least 18 years old or have the consent of a legal guardian to use our services. By using the Website, you affirm that you meet these requirements. 

1. Digital Artwork: We will not use your artwork anywhere without your permission. However, Artists retain full ownership and copyright of their digital artwork. With permission from you we will post to HPD Socials. (Twitter, YouTube, Instagram, Ko-Fi, and Patreon). You cannot legally edit, trace, or resell our artwork for your own gain or use. 

1. Socials: We do not take responsibility for where you use or post your finished product. If the artwork is rejected by social media or flagged it is not our responsibility to refund or change the finished product. 

1. Art coverage: We will not process any transactions of request for anything NSFW, racist, sexist, political, lewd or demeaning to others.  

1. Distribution: Files and attachments will be sent through Google Drive in a zipped file. All files will be in PNG format by default. If you request a different type, it will be considered depending on what type you request. 

1. User Conduct: Users are prohibited from engaging in any conduct that may disrupt, damage, or impair the functionality of the Website. This includes, but is not limited to, hacking, transmitting malware, or engaging in any activity that violates applicable laws. 

1. Purchases and Payments: Users may purchase digital art through FIVERR. Prices are displayed in USD. Payments are processed securely through FIVERR. Users agree to provide accurate and complete payment information. 

1. Refund Policy: Refunds are issued at the discretion of HPD staff. If you encounter any issues with a purchase, please contact our customer support team at honeypunkdesign@gmail.com for assistance. 

1. Intellectual Property: All content on the Website, including text, images, logos, and digital artwork, is the property of HPD or its licensors and is protected by copyright and other intellectual property laws. 

1. Privacy Policy: Our Privacy Policy, available on our website, outlines how we collect, use, and protect your personal information. By using our services, you agree to the terms of our Privacy Policy. 

1. Termination of Services: We reserve the right to terminate or suspend access to our services for any user who violates these Terms or engages in any prohibited conduct. 

1. Disclaimer of Warranties: Our artwork is provided "as is" without any warranties. HPD will finalize the product with the consumer before distribution. You will have 60 days to request edits at cost of time rates.  

1. Limitation of Liability: HPD shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. 

1. Governing Law: These Terms are governed by and construed in accordance with the laws of the state of California. Any legal action or proceeding arising out of or relating to these Terms shall be settled in the courts of California.
